Terms of Use

These Terms of Use ("Terms") govern your use of the AleSpot mobile application ("the App"), operated by AleSpot ("we", "us"). By using the App, you agree to these Terms. If you don't agree, please don't use the App.

1. Eligibility

The App features venues and events that may serve alcohol. You must be of legal drinking age in your country or region to use it, and you confirm this when you first open the App. If the minimum age required to agree to these Terms in your country is higher than your local legal drinking age, that higher age applies instead. We may suspend or terminate access for anyone we believe does not meet this requirement.

2. Data we collect (summary)

In short: we collect your email address to log you in, location data to power search and alerts, and content you submit (see §4). We also use ad networks that collect data (such as advertising identifiers) to show ads, with a consent choice for EEA/UK users. Full detail, including every third party involved, is in our Privacy Policy — these Terms cover your conduct and content; the Privacy Policy covers data handling.

3. Your account

Login is passwordless, via a one-time link sent to your email. You're responsible for keeping access to that email address secure. Let us know immediately at contact@alespot.com if you believe your account has been accessed without your permission.

When you submit a pin (a venue, event, or point of interest), including any name, description, photo, or link, you confirm that:

5. Content ownership

You retain ownership of any content you submit. We don't claim ownership over it. By submitting it, you grant us a non-exclusive, royalty-free licence to display, store, and distribute it within the App for as long as it remains published, as necessary to operate the App's core features.

6. Our intellectual property

Other than content you submit, the App itself — including its design, branding, the AleSpot name and logo, and underlying software — belongs to us or our licensors. Using the App gives you a personal, non-transferable right to use it as intended; it doesn't give you any right to copy, redistribute, or create derivative works from the App itself.

7. Removal of content

We may edit, reject, or remove any submission at our discretion, including after publication and without notice — for example if it's inaccurate, violates these Terms, or is reported as a problem.

If you want a pin you submitted removed, contact us at contact@alespot.com or use the in-app report/edit options on the pin. Deleting your account (§15) unlinks your past submissions from you, but a listing describing a real, public venue or event may remain visible after that, since it describes the place or event rather than you personally; we will consider full removal requests case by case.

Reporting content you don't control: if you believe a pin, photo, or other content in the App is illegal, infringes your rights, or otherwise shouldn't be there — whether or not you have an account — you can report it to contact@alespot.com. Tell us what the content is, where to find it, and why you believe it's a problem. We'll review reports and let you know the outcome once we've acted on them.

8. Event Disclaimer

Event information is provided for convenience only. Dates, times, locations, and ticket availability may change. Users should verify details with the event organiser before relying on them.

More generally, pins are largely user-submitted: we moderate them, but we don't guarantee that any venue, event, opening hours, or other detail shown in the App is accurate, current, or complete.

9. We don't endorse listed venues

Listing a venue or event in the App is not an endorsement or recommendation by us, and doesn't imply any relationship between us and that venue. We are not responsible for your experience at any listed location, and we encourage everyone to drink responsibly and follow local laws.

10. Third-party links

Pins and other content may include links to third-party websites (e.g. a venue's own site or a ticketing page). We don't control and aren't responsible for the content, accuracy, or practices of any site you reach through such a link. Visiting a linked site is at your own risk and subject to that site's own terms and privacy policy.

12. Advertising and purchases

The App is funded in part by advertising. Ad networks (currently Google AdMob) collect data such as advertising identifiers and approximate location to show ads — see our Privacy Policy for detail and how to manage consent.

If we introduce paid features in future, they will be billed and fulfilled through the relevant app store (Apple App Store / Google Play), and refunds are subject to that store's own policies. Under EU consumer law, you may lose the right to withdraw from such a purchase once the digital service begins immediately with your consent and acknowledgment of that loss — we'll ask for that acknowledgment at the point of purchase.

13. "As-is", no warranty

The App is provided "as is", without warranties of any kind, to the fullest extent permitted by law. We don't guarantee the App will be uninterrupted, error-free, or available at all times, and we may change, suspend, or discontinue any part of the App at any time.

14. Liability limitations

To the fullest extent permitted by Dutch law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the App, including but not limited to reliance on inaccurate listing or event information, or issues encountered at a listed venue. Nothing in these Terms limits liability that cannot be limited under applicable law.

15. Termination

You may stop using the App and delete your account at any time (Settings → Account → Delete my account). We may suspend or terminate your access if you violate these Terms.

If we terminate or suspend your access for violating these Terms, we may retain the minimum data necessary (e.g. your email or an equivalent identifier) to enforce that suspension and prevent re-registration, even if you separately request deletion — see our Privacy Policy.

16. General provisions

If any part of these Terms is found unenforceable, the rest remains in effect. Our not enforcing a provision on one occasion doesn't waive our right to enforce it later. We may transfer these Terms and our rights under them (for example, if the App or its operating business is transferred); you may not transfer your rights under these Terms to anyone else.

17. Apple App Store users

This section only applies if you downloaded the App from the Apple App Store; it has no effect for the Android/Google Play version.

18. Changes to these Terms

We may update these Terms from time to time. Material changes will be flagged in the App. Continued use after an update means you accept the revised Terms.

19. Governing law

These Terms are governed by the laws of the Netherlands. Any dispute arising from these Terms or your use of the App will be submitted to the competent court in the Netherlands, without prejudice to any mandatory consumer-protection rights you have in your own country of residence if you are an EU consumer.
